
Spanish Wells Unit Three HOA
Proposed changes to our Protective Covenants which is anticipated to be adopted on March 9, 2022 is provided below.

Pets. The keeping of pets is a privilege, not a right. No more than three (3) commonly accepted household pets, such as dogs or cats, parakeets and goldfish (kept in a tank and in reasonable numbers) are permitted, and subject to the Association’s Rules and Regulations adopted from time to time. No reptiles, amphibians or exotic pets may be kept in or on the Property. No poultry, livestock or other farm animals are permitted. No breeding or boarding or other commercial activities involving animals are permitted. Pets may not roam free. All pets must always be leashed and in the control by their owner or handler when off the owner’s Lot. Control means immediate and continuous physical control of an animal at all times such as a handheld leash not to exceed 8 feet in length, cord, or chain of sufficient strength to restrain the pet. An electronic confinement system will be deemed acceptable if the equipment is properly installed and maintained in continuous working order and the pet being contained wears the appropriate electronic collar when within the system perimeter. Pets may not be chained or left in a yard at any time without the owner present unless utilizing an approved electronic confinement system. Owners are responsible to ensure that all feces or other pet messes are immediately removed from the common areas and lots and placed in the owner’s sanitary trash receptacle.

No dangerous or vicious breeds will be allowed on the Property, and the Board of Directors shall have the sole discretion to determine whether a pet is a dangerous or vicious breed or otherwise unreasonable threat to other residents. If the Board of Directors, in its sole discretion, determines a pet is dangerous or vicious or otherwise unreasonable to other residents, it shall have the authority to order the permanent and immediate removal of such pet. The Board of Directors, in its sole discretion, shall have the right to determine if a pet constitutes a nuisance and shall have the authority to order the permanent and immediate removal of any pet which becomes an unreasonable source of annoyance to other residents in the community.

Any Owner or other resident who keeps or maintains any pet shall, in exchange for and in consideration of the privilege to keep the pet, hereby indemnify and hold the Association free and harmless from any loss, claim or liability of any kind or character of whatever nature arising from or related to the keeping or maintaining of such pet in the community.
