CONTRACTOR RULES & REGULATIONS
(Approved by SWCA BOD, 10/18/2004)
HOURS OF OPERATION FOR SPANISH WELLS PROPERTY:
WEEKDAYS 7:00 AM TO 6:00 PM
SATURDAYS 7:00 AM TO 4:00 PM
SUNDAYS/HOLIDAYS NO WORK PERMITTED (see Emergency Exception Information, below)
HOURS OF OPERATION WILL BE STRICTLY ENFORCED. ALL PERSONNEL MUST EXIT BY THE END OF EACH DAY'S HOURS OF OPERATION.
RULES AND REGULATIONS:
• SPEED LIMIT IS 25 M.P.H.
• ALL TRAFFIC SIGNS AND REGULATIONS MUST BE OBEYED AT ALL TIMES.
• NO SOLICITING.
• NO DUMPING.
• THE WORK SITE MUST REMAIN CLEAN AND PICKED UP – DUMPSTERS MUST BE USED FOR DEBRIS.
• DUMPSTERS MAY NOT BE PLACED IN THE ROAD.
• PORTA-POTTYS MUST BE KEPT OFF THE ROAD AND MUST HAVE THE DOOR FACING THE BUILDING UNDER CONSTRUCTION.
• THE ROAD ADJACENT TO THE WORK AREA(S) MUST BE KEPT CLEAN, CLEAR OF DEBRIS AND OPEN TO TRAFFIC.
• THE CONTRACTOR MUST HAVE THE STREET ADDRESS. SUBCONTRACTORS MUST HAVE A DESCRIPTION OF HOW TO GET TO THE WORK SITE.
• THE CONTRACTOR AND OR HIS WORKERS MUST BE ABLE TO COMMUNICATE IN ENGLISH OR HAVE WRITTEN INFORMATION DESCRIBING THE JOB LOCATION. MAIN GATE SECURITY PERSONNEL WILL NOT ESCORT WORKERS TO A SITE. THEY MUST KNOW WHERE THEY ARE GOING OR HOW TO GET THERE, OR THEY WILL BE TURNED AWAY.
• NO ALCOHOL IS ALLOWED AT ANY TIME. IF ALCOHOL IS FOUND ON A JOB SITE OR ON A WORKER THE ENTIRE CREW WILL BE REQUIRED TO LEAVE IMMEDIATELY REGARDLESS OF WHAT THE TIME OF DAY AND EVEN IF THE JOB IS NOT COMPLETED.
• NO ILLEGAL DRUGS OF ANY KIND AT ANY TIME. IF ILLEGAL DRUGS ARE FOUND ON A JOB SITE OR ON A WORKER THE ENTIRE CREW WILL BE REQUIRED TO LEAVE IMMEDIATELY REGARDLESS OF WHAT THE TIME OF DAY AND EVEN IF THE JOB IS NOT COMPLETED.
• NO PETS, FIREARMS, OR LOUD RADIOS ALLOWED.
• NO FISHING OR SWIMMING AT ANY TIME.
• PARK VEHICLES AS CLOSE TO WORK SITE AS POSSIBLE. DO NOT PARK ON CURVES, AT INTERSECTIONS, ACROSS FROM ANOTHER VEHICLE, OR IN ANY MANNER THAT WILL BLOCK OR INTERFERE WITH TRAFFIC.
• NO CHILDREN UNDER THE AGE OF 16 YEARS ARE ALLOWED.
• NO EQUIPMENT SHALL REMAIN AT THE WORK SITE WITHOUT APPROVAL.
• NO WORK SITE MAY PLUG INTO ELECTRICITY OR OBTAIN WATER FROM AN ADJACENT PROPERTY WITHOUT THE EXPRESS WRITTEN PERMISSION FROM THAT PROPERTY OWNER.
• WORKERS WILL NOT ROAM SPANISH WELLS PROPERTY. THEY ARE TO GO DIRECTLY TO AND FROM THE WORK SITE.
• NO POSTING OF BUSINESS OR COMPANY SIGNS. A PERMIT BOARD IS THE ONLY SIGN ALLOWED.
FAILURE TO COMPLY WITH THE RULES AND REGULATIONS MAY RESULT IN SUSPENSION OF WORK PRIVILEGES AND/OR RESTRICTION FROM SPANISH WELLS PROPERTY. RULES MAY BE MODIFIED BY THE COMMUNITY MANAGER, THE BOARD, OR COMMUNITY WATCH AT ANY TIME WITHOUT PRIOR NOTIFICATION. CONTACT THE OFFICE AT

Emergency Exception Information:
The SWCA Rules and Regulations specifically state the following:
“No vendors will be allowed on Sunday or holidays with the exception of emergency activities (i.e., A/C, electrical, plumbing, etc.) or if a state of emergency is in effect.” and “If work needs to be extended after hours due to an emergency, the SWCA office must be informed at 239-319-1288 Monday through Friday between 9:00 a.m. and 4:00 p.m. For after-hours vendor response, residents need to call 239-445-8739 and provide the vendor’s name, address, and purpose.”
SWCA does not identify what constitutes an emergency so owners should make their best judgement. Homeowners and/or their home watch representatives are also encouraged to do the following:

Add the word “EMERGENCY” after the vendor’s name when entering it into their guest list on DwellingLive (for example: Castle Group - EMERGENCY).

Add this vendor as a temporary guest for that specific day only to draw attention to it.

Tell the vendor to identify themselves as an emergency service at the gate when checking in with the attendant.
This helps the gate staff quickly identify and verify legitimate emergency access while maintaining proper community security. It is important to point out that all guests and vendors must always be added to DwellingLive.
